TERMS & CONDITIONS
Effective Date: 9/13/26 V1
These Terms & Conditions (“Terms”) apply to orders for floral preservation services and related custom keepsakes purchased from B Creative Floral Preservation (“B Creative,” “we,” “us,” or “our”).
By placing an order through our website, completing checkout, submitting payment, or otherwise electronically accepting these Terms, you (“Client,” “you,” or “your”) acknowledge that you have had an opportunity to review these Terms and agree to be bound by them with respect to the preservation services and products included in your order.
These Terms are intended to establish clear expectations regarding our preservation process, custom artwork, payment, timelines, flower condition, design, shipping, cancellations, and care of finished pieces.
1. ORDERING AND ACCEPTANCE
1.1 Online Orders
When you place an order through the B Creative website, you are purchasing the specific preservation service and/or finished keepsake identified in your order.
Before completing checkout, you will be asked to acknowledge that you have read and agree to these Terms & Conditions.
Your order is not considered accepted until B Creative receives your order and payment and confirms the order through our normal business process.
1.2 Electronic Acceptance
Your electronic acceptance of these Terms, including checking an agreement box during checkout or completing another electronic acceptance process, is intended to have the same contractual effect as a written acknowledgment to the extent permitted by applicable law.
You are responsible for reviewing these Terms before placing your order.
1.3 Order-Specific Terms
Your order confirmation, selected product, applicable product description, pricing displayed at checkout, and any written order-specific terms communicated by B Creative may form part of the agreement between you and B Creative.
If an order-specific written term expressly conflicts with these Terms, the order-specific term will control only with respect to that specific conflict.
1.4 Accuracy of Client Information
You are responsible for providing accurate and current information, including your name, email address, telephone number, shipping address, event information, and any other information reasonably necessary to complete your order.
B Creative is not responsible for delays or additional costs caused by inaccurate, incomplete, or outdated information supplied by the Client.
2. CUSTOM NATURE OF FLORAL PRESERVATION
Floral preservation is a custom, handmade process involving natural materials.
Each bouquet is different, and flowers do not respond identically to drying, preservation, handling, finishing, or display.
The finished piece may therefore differ from photographs of previous work, website examples, social-media images, inspiration images, or the appearance of the original fresh flowers.
By ordering, you acknowledge that natural variation and reasonable artistic variation are inherent characteristics of custom floral preservation.
B Creative will use reasonable professional care and its artistic judgment in creating your keepsake.
3. ARTISTIC STYLE AND CREATIVE DISCRETION
You acknowledge that you are hiring B Creative based upon its established style, portfolio, preservation methods, and artistic approach.
B Creative will make reasonable efforts to create a finished piece consistent with the product purchased and the design information provided by the Client.
However, B Creative retains reasonable artistic discretion regarding:
placement of flowers;
orientation of flowers;
spacing;
composition;
flower selection where necessary;
arrangement of greenery and other natural materials;
preservation and finishing techniques;
color correction when purchased or otherwise agreed upon;
minor design adjustments necessary to create a structurally appropriate finished piece.
Because natural flowers vary in size, shape, condition, color, and durability, an exact reproduction of a photograph, inspiration image, or previous B Creative piece cannot be guaranteed.
A reasonable difference in artistic interpretation or the natural appearance of preserved flowers does not constitute a defect or failure to perform the agreed service.
4. PRODUCT SELECTION AND ORDER CHANGES
The Client is responsible for reviewing the product description, dimensions, included services, and applicable options before placing an order.
Once an order has been placed, changes may not always be possible.
Whether a requested change can be accommodated depends on the stage of the preservation process and the materials already purchased or work already performed.
If a requested change requires additional materials, labor, design work, shipping, or other expenses, B Creative may require payment of the applicable additional cost before proceeding.
Once certain stages of the project have begun, an order may no longer be eligible for changes.
5. PAYMENT
5.1 Standard Online Orders
Unless otherwise agreed in writing, the total purchase price for an online order is due in full at checkout.
B Creative is not required to begin or continue work on an order for which payment has not been successfully received.
5.2 Payment Processing
Payments are processed through the payment method made available at checkout.
B Creative is not responsible for delays caused by declined, reversed, expired, or otherwise unsuccessful payment methods.
5.3 Taxes and Additional Charges
Applicable sales tax, shipping charges, optional upgrades, additional design services, color correction, replacement materials, or other agreed charges may be added to the order where applicable.
6. APPROVED PAYMENT PLANS
Payment plans are not automatically available for every order.
If B Creative agrees in writing to a payment plan, the payment schedule communicated to the Client becomes part of the order terms.
Unless otherwise stated in writing:
an initial payment may be required before work begins;
each scheduled payment must be received by its due date;
B Creative may pause work if a scheduled payment is not received;
delays caused by unpaid balances may extend the estimated completion timeline;
B Creative may require an overdue balance to be brought current before continuing work.
If a payment remains unpaid after B Creative provides written notice and a reasonable opportunity to cure the missed payment, B Creative may suspend or terminate the project as permitted by applicable law and the terms of the order.
The Client remains responsible for amounts properly due for services, materials, or work already performed.
7. CANCELLATIONS AND REFUNDS
7.1 Custom Nature of Orders
Because floral preservation orders involve custom labor, materials, preparation, preservation space, and eventually individualized artwork, cancellation may result in costs that cannot be recovered by B Creative.
Accordingly, custom orders are generally non-refundable once B Creative has incurred costs or begun work on the order, subject to any rights or remedies that cannot lawfully be excluded or limited.
7.2 Cancellation Before Work Begins
If a Client requests cancellation before B Creative has incurred material costs or begun work, B Creative may determine whether any refund is appropriate based on the circumstances of the order and applicable law.
Any refund, if applicable, may be reduced by non-recoverable costs already incurred on the Client's behalf.
7.3 Cancellation After Flowers Are Received
Once flowers have been received, processed, dried, preserved, arranged, or otherwise incorporated into the project, cancellation may result in little or no refundable amount because significant labor and materials may already have been committed.
If cancellation is requested after work has begun, B Creative will determine any amount potentially refundable based on work performed, materials purchased, and other non-recoverable costs, subject to applicable law.
7.4 Cancellation After Production Has Begun
Once B Creative has begun final assembly, finishing, casting, mounting, framing, fabrication, or another irreversible production stage, cancellation may no longer be possible.
7.5 No Refund for Change of Mind or Artistic Preference
A Client's change of mind, failure to review the website information before ordering, or dissatisfaction based solely on reasonable artistic interpretation or natural preservation results does not automatically entitle the Client to a refund.
Nothing in these Terms limits any rights that cannot legally be waived.
8. FLOWER SUBMISSION
The quality of the final keepsake is substantially affected by the condition of the flowers when B Creative receives them.
8.1 Freshness
Whenever possible, flowers should be delivered or shipped to B Creative as soon as reasonably possible after the event.
For best preservation results, flowers should generally reach B Creative within approximately two days after the event.
This is a recommendation rather than a guarantee that flowers received later cannot be preserved.
The longer flowers remain after an event, the greater the possibility of wilting, bruising, browning, petal loss, dehydration, mold, or other changes.
8.2 Client Responsibility
The Client is responsible for following B Creative's current flower-delivery instructions.
If the Client chooses to ship flowers, the Client is responsible for properly packaging the flowers and selecting an appropriate shipping method.
B Creative cannot guarantee the condition of flowers affected by improper packaging, carrier delays, extreme temperatures, mishandling, or other events occurring before B Creative receives them.
8.3 Drop-Offs
For local drop-offs, the Client is responsible for following B Creative's current drop-off instructions, hours, and location requirements.
Flowers should not be left outside or at an unattended location unless B Creative has specifically authorized that method.
8.4 Leftover Flowers
B Creative only preserves the amount of flowers needed to make the ordered products. The remaining flowers, vases, other person items not going into the keepsake will be disposed of at time of drop off. If client would like to take home the remaining fresh flowers and or items: They must request at the time of drop off, and remain on premises while we remove what we need to make the order. Any additional flowers that might be leftover after completing the project will be disposed of unless client request them back at pick up. There is no guarantee any flowers will be remaining.
9. CONDITION OF FLOWERS UPON RECEIPT
B Creative accepts natural flowers in the condition in which they are received.
Flowers may contain damage or deterioration that is not visible from the outside, including:
bruising;
weak or damaged stems;
internal discoloration;
petal damage;
dehydration;
bruising from handling;
damage occurring during shipping;
disease or mold;
previous environmental damage.
B Creative cannot guarantee that every flower will survive the preservation process.
Where reasonably necessary, B Creative may determine that a particular flower is unsuitable for the selected preservation method.
10. NATURAL CHANGES DURING PRESERVATION
Preservation does not permanently freeze flowers in precisely the condition in which they were received.
Natural changes may include:
color changes;
fading or darkening;
changes in saturation;
changes in texture;
shrinkage;
petal separation;
brittleness;
translucency;
changes in shape;
changes in size;
curling;
minor warping;
loss of delicate petals;
changes caused by moisture content.
These changes can occur even when B Creative follows its normal preservation procedures.
For example, white flowers may become cream or pale yellow; pink flowers may lighten, darken, or shift toward purple; red roses may become significantly darker; and other vivid colors may become more muted.
These are natural characteristics of preserved flowers and are not necessarily defects.
11. FLOWERS THAT DO NOT PRESERVE AS EXPECTED
Certain flowers, foliage, or plant materials may be more difficult to preserve successfully because of their moisture content, structure, delicacy, maturity, or other characteristics.
Some flowers may:
fail to dry properly;
become brittle;
become misshapen;
discolor;
brown;
become translucent;
lose petals;
collapse;
develop cracks or other preservation-related changes.
B Creative will use reasonable professional judgment to determine whether a flower can be incorporated safely and appropriately into the finished piece.
If a flower cannot reasonably be used, B Creative may omit it or, where appropriate, substitute another suitable flower or natural element.
12. SUBSTITUTIONS AND ARTISTIC ADJUSTMENTS
If a particular flower does not survive preservation or cannot reasonably be incorporated into the selected product, B Creative may make a reasonable substitution or adjustment consistent with the overall design.
B Creative may also make minor substitutions or adjustments when necessary for structural, aesthetic, preservation, or production reasons.
B Creative will not intentionally make a material substitution that fundamentally changes the nature of the order without reasonable communication with the Client when communication is practical.
Because natural materials are unpredictable, the Client acknowledges that exact flower-for-flower replication cannot always be guaranteed.
13. COLOR CORRECTION
Preservation can alter the appearance of natural flower colors.
Where available, B Creative may offer color correction or airbrushing as an additional service.
Color correction can improve or alter the appearance of preserved flowers, but it cannot guarantee an exact recreation of the original fresh-flower color.
If the Client wants color correction, it should be requested before final production whenever reasonably possible.
Color correction may involve additional charges.
14. DESIGN MOCKUPS AND APPROVAL
Where a mockup is included with the Client's selected product, B Creative may provide a proposed layout for approval before final production.
Mockups are intended to communicate the general composition and placement of the preserved materials.
Because natural flowers vary in size and condition and because some flowers may change during preservation, the final finished piece may contain reasonable differences from the approved mockup.
14.1 Client Review
The Client is responsible for reviewing the mockup carefully and communicating requested changes within the response period provided by B Creative.
14.2 Included Revision
Where applicable to the purchased product, B Creative will provide one reasonable redesign at no additional charge.
Additional redesigns requested by the Client may be subject to a design fee, currently $50 per additional mockup unless otherwise stated in writing.
A redesign requested because B Creative made an error in carrying out an approved design will not be treated as a Client-requested paid redesign.
14.3 No Response
If the Client does not respond to a design approval request after reasonable notice and the response period stated by B Creative has expired, B Creative may proceed using the most recent proposed design or information available.
B Creative may make reasonable efforts to contact the Client before proceeding.
If the Client has failed to respond after the stated response period and B Creative proceeds, the resulting delay or additional work caused by the Client's failure to respond may be the Client's responsibility.
15. PRODUCTS WITHOUT MOCKUPS
Certain products may not include a mockup or advance design approval because of their size, construction, production method, or artistic nature.
These may include, without limitation, All shadow box products, Glass box products, candle holders, ring holders, jewelry pieces, wine stoppers, and other products identified by B Creative as not requiring or permitting a mockup.
For such products, B Creative will use its professional and artistic judgment based on the flowers received and the product ordered.
16. CLIENT COMMUNICATION
B Creative primarily communicates with Clients through email and, where applicable, its client portal or other designated communication system.
The Client is responsible for:
providing a current email address;
monitoring email communications;
checking spam/junk folders;
responding to requests requiring Client input;
keeping contact information current.
B Creative is not responsible for delays resulting from the Client's failure to receive, read, or respond to a communication sent to the contact information provided by the Client.
17. ESTIMATED TURNAROUND TIME
B Creative's current estimated turnaround time is approximately 5–8 months.
This is an estimate, not a guaranteed completion date, unless B Creative has expressly agreed otherwise in writing.
The actual completion time may vary depending on:
order volume;
seasonal demand;
flower condition;
preservation requirements;
drying time;
design revisions;
availability of materials;
supplier delays;
equipment or facility issues;
shipping delays;
Client response times;
payment delays;
requested changes or upgrades;
circumstances outside B Creative's reasonable control.
B Creative will make reasonable efforts to complete orders in a timely manner, but an estimated turnaround time does not constitute a promise that the finished piece will be completed by a specific date.
18. DELAYS OUTSIDE B CREATIVE'S REASONABLE CONTROL
B Creative will not be responsible for delays caused by circumstances outside its reasonable control, including but not limited to:
severe weather;
natural disasters;
fire;
flooding;
power outages;
equipment failure;
supplier interruptions;
shipping disruptions;
governmental restrictions;
public emergencies;
illness or other circumstances materially affecting operations;
labor disruptions;
unexpected preservation complications;
events affecting the facility or materials.
When reasonably practical, B Creative will communicate material delays to affected Clients.
19. FINISHED PRODUCT AND HANDMADE IMPERFECTIONS
B Creative's products are handmade and incorporate natural materials.
Reasonable handmade characteristics may include:
minor variations in surface appearance;
small bubbles, pits, divots, or other production marks where applicable;
variations in placement;
natural variation between flowers;
differences between the finished product and photographs;
variations in color;
small variations in dimensions;
natural imperfections within preserved flowers.
Such characteristics are not automatically defects.
B Creative will use reasonable care and craftsmanship, but handmade preservation should not be expected to have the uniformity of a mass-produced manufactured product.
20. ITEMS AND MATERIALS PROVIDED BY THE CLIENT
If the Client provides personal items, jewelry, invitations, ribbons, charms, photographs, fabric, or other non-floral materials for incorporation into a keepsake, B Creative will use reasonable care in handling those items.
However, B Creative cannot guarantee that every item is suitable for every preservation or production method.
Materials may be affected by:
heat;
pressure;
moisture;
drying;
adhesives;
coatings;
finishing materials;
other production processes.
The Client should notify B Creative in advance of any item that requires special handling.
B Creative may decline to incorporate an item that it reasonably believes could be damaged, compromise the finished product, or be incompatible with the selected preservation method.
21. SHIPPING FLOWERS TO B CREATIVE
If flowers are shipped to B Creative, the Client assumes responsibility for selecting the shipping carrier, payment to that carrier, shipping method, packaging, and delivery address.
B Creative is not responsible for loss, delay, theft, temperature exposure, or damage occurring before the flowers are received by B Creative.
If flowers arrive damaged, delayed, wilted, or otherwise compromised, B Creative will use reasonable professional judgment to determine what portions can still be preserved.
The Client acknowledges that shipping fresh flowers carries inherent risk.
22. SHIPPING FINISHED PRODUCTS
Finished products may be shipped when the applicable order includes or the Client selects shipping.
Shipping charges may be separate from the preservation price unless expressly stated otherwise.
The Client is responsible for providing a complete and accurate delivery address.
Once a finished product has been shipped, the Client should promptly inspect the package and finished product.
If a package arrives visibly damaged, the Client should photograph the packaging and product before disposing of any packaging materials and should contact B Creative promptly.
B Creative may require photographs, shipping information, packaging, or other documentation when evaluating a shipping-related claim.
23. LOST, STOLEN, OR MISDIRECTED SHIPMENTS
B Creative is not responsible for loss resulting from an incorrect address supplied by the Client, refusal of delivery, failure to retrieve a package, or theft after confirmed delivery.
If a package is lost or damaged by a shipping carrier, B Creative will reasonably assist with any applicable carrier claim where appropriate.
The outcome of a carrier claim may depend on the carrier's policies, available insurance, shipping method, and circumstances of the loss.
Nothing in this section limits rights or remedies that cannot legally be excluded.
24. PICKUP AND UNCLAIMED FINISHED PRODUCTS
If an order is designated for local pickup, B Creative will notify the Client when the finished product is ready.
The Client is responsible for arranging pickup within the timeframe communicated by B Creative.
If a finished product remains unclaimed for an extended period, B Creative may send written reminders and provide the Client with a reasonable opportunity to arrange pickup or shipping.
If the Client does not respond after reasonable written notice, B Creative may treat the order as abandoned as permitted by applicable law.
B Creative will not dispose of or otherwise transfer ownership of an unclaimed finished product without first following the notice and procedures required by applicable law.
25. NONPAYMENT AND PROJECT ABANDONMENT
If an amount remains unpaid, B Creative may pause further work until the account is brought current.
B Creative will provide written notice of a material payment default and, where appropriate, an opportunity to cure the default.
If the Client fails to cure the default after reasonable notice, B Creative may cancel or terminate the project to the extent permitted by applicable law.
Amounts properly owed for completed work, materials, preservation services, or other services already performed may remain due.
B Creative will not claim ownership of Client property or dispose of Client property solely because of nonpayment unless permitted by applicable law and after providing any notice required by law.
26. CARE AND USE OF FINISHED PRODUCTS
Finished preservation pieces are decorative keepsakes intended for display unless a particular product is expressly designed for another purpose.
The Client is responsible for displaying and handling the finished piece appropriately.
Unless otherwise specified for the particular product:
keep the piece away from direct sunlight;
avoid prolonged exposure to heat;
avoid excessive humidity or moisture;
do not place the piece where it can easily be knocked over;
handle delicate pieces carefully;
use appropriate hardware and support when displaying hanging pieces;
clean surfaces gently with a microfiber cloth
Preserved flowers are delicate and may change over time due to normal aging and environmental conditions.
B Creative does not guarantee that a preserved flower will remain unchanged indefinitely.
27. PRODUCTS ARE NOT INTENDED FOR FOOD CONTACT
Unless a product is expressly identified by B Creative as suitable for food contact, preservation pieces are decorative and should not be used for food preparation, serving, or storage.
Clients should not assume that any decorative coating, adhesive, preservation material, or finish is food-safe merely because it appears similar to a food-service material.
28. SAFETY AND DISPLAY
The Client is responsible for selecting an appropriate and secure location for displaying the finished product.
Some finished pieces may be heavier or more fragile than they appear.
B Creative is not responsible for damage caused by improper installation, improper display, dropping, impact, misuse, unauthorized modification, or failure to follow reasonable care instructions.
29. DAMAGE AFTER DELIVERY OR PICKUP
B Creative is responsible for its workmanship subject to these Terms.
However, B Creative is not responsible for damage caused after delivery or pickup by:
dropping;
impact;
improper handling;
improper installation;
exposure to heat, moisture, or sunlight;
improper cleaning;
unauthorized repairs or modifications;
accidents;
misuse;
ordinary aging.
If a Client believes a finished piece has a workmanship issue, the Client should contact B Creative promptly with photographs and a description of the concern.
B Creative will evaluate the issue and determine whether repair, replacement, or another reasonable resolution is appropriate based on the circumstances.
30. CLIENT-REQUESTED MODIFICATIONS AFTER COMPLETION
Any alteration, repair, disassembly, refinishing, or modification performed by someone other than B Creative may affect the integrity of the finished piece.
B Creative is not responsible for damage caused by unauthorized modification or repair.
If a Client requests a modification after completion, B Creative may determine whether the requested work is possible and may charge an additional fee.
31. LIMITATION OF RESPONSIBILITY FOR NATURAL MATERIALS
B Creative cannot guarantee that flowers will retain their original appearance after preservation.
B Creative's responsibility is to use reasonable professional care and its established preservation methods.
B Creative is not responsible for natural changes inherent in the preservation process, including changes in color, texture, shape, size, translucency, brittleness, or other characteristics that occur despite reasonable care.
This provision does not excuse B Creative from responsibility for conduct that applicable law does not permit a business to exclude or limit.
32. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, B Creative will not be responsible for indirect, incidental, special, or consequential losses arising from an order when such damages may lawfully be excluded.
B Creative's responsibility for a claim arising from a preservation order will be determined based on the circumstances, applicable law, the services purchased, and the actual loss established.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law, including any rights or remedies that cannot legally be waived.
33. INDEMNIFICATION
To the extent permitted by applicable law, the Client agrees to be responsible for claims, losses, or expenses arising from the Client's own negligent, intentional, unauthorized, or improper use of a finished product or materials provided by the Client.
This provision does not require the Client to indemnify B Creative for liability to the extent caused by B Creative's own conduct where such indemnification is prohibited or restricted by applicable law.
34. PHOTOGRAPHY AND PORTFOLIO USE
B Creative may photograph finished preservation pieces for its portfolio, website, social media, advertising, educational materials, and other business purposes.
B Creative will use reasonable care to avoid unnecessarily displaying personal identifying information belonging to the Client.
Unless separately agreed otherwise, the Client understands that the finished artwork may be photographed and displayed as an example of B Creative's work.
If the Client has a specific privacy concern regarding an identifiable personal item, name, photograph, invitation, or other private material incorporated into the piece, the Client should notify B Creative before production.
35. INTELLECTUAL PROPERTY
B Creative retains ownership of its original business materials, including its branding, website content, photographs created by B Creative, design concepts, templates, written materials, and other original intellectual property, except where ownership belongs to another party under applicable law.
The Client owns the physical finished keepsake after all amounts due for that order have been paid, subject to any rights of third parties and applicable law.
Ownership of the physical keepsake does not transfer ownership of B Creative's underlying business materials, photographs, designs, branding, or other intellectual property.
36. CLIENT-PROVIDED CONTENT
The Client represents that the Client has the right to provide B Creative with any photographs, artwork, text, names, initials, logos, or other materials supplied for use in the project.
The Client is responsible for obtaining any permissions necessary for materials that do not belong to the Client.
37. COMMUNICATION OF IMPORTANT CHANGES
B Creative may update its Terms & Conditions from time to time.
The Terms applicable to an order will generally be the Terms accepted by the Client when that order is placed, unless the Client and B Creative expressly agree otherwise in writing or applicable law requires otherwise.
Updated Terms may apply to future orders.
38. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be limited or severed to the extent necessary, and the remaining provisions will continue to the extent permitted by law.
No provision is intended to waive or eliminate a right that applicable law does not permit the parties to waive.
39. GOVERNING LAW
These Terms and the relationship between B Creative and the Client will be governed by the laws of the State of New Jersey, except to the extent applicable law requires otherwise.
Nothing in these Terms is intended to prevent a Client from exercising rights or remedies that applicable law provides.
40. ENTIRE AGREEMENT
These Terms, together with the applicable order confirmation, product description, payment information, and any written order-specific terms agreed to by B Creative and the Client, constitute the agreement concerning the applicable order.
The Client acknowledges that the Client has not relied upon any representation concerning the order that is inconsistent with the written order terms or these Terms, except where such reliance cannot lawfully be disclaimed.
41. CLIENT ACKNOWLEDGMENT
By placing an order with B Creative, the Client acknowledges and understands that:
Floral preservation is a custom and handmade process.
Natural flowers can change in color, shape, size, texture, and appearance during preservation.
Not every flower is guaranteed to survive the preservation process.
The final piece may differ reasonably from photographs, examples, or inspiration images.
The estimated turnaround time is approximately 5–8 months and is not a guaranteed completion date.
The Client is responsible for providing accurate contact and shipping information.
The Client is responsible for reviewing and responding to design communications when a response is requested.
Custom orders may not be cancellable or refundable once B Creative has incurred substantial costs or begun work, subject to applicable law.
Finished preservation pieces require appropriate care and handling.
These Terms apply to the specific preservation service and/or product purchased by the Client.
42. ELECTRONIC ACCEPTANCE
By checking the box indicating agreement to these Terms & Conditions and completing the order, the Client confirms:
“I have read and agree to the B Creative Floral Preservation Terms & Conditions.
